Publicly appointed surveying engineers can use electronic signature according to the eIDAS regulation
(Leipzig, ) Since the beginning of 2025, the Association of Publicly Appointed Surveying Engineers (BDVI) has enabled its members to use electronic signatures in conjunction with the Sign Live! software solution. To this end, the BDVI has concluded a framework agreement with intarsys. This allows members to purchase the Sign Live! signature solution at a subsidized rate.
More and more federal states are demanding electronic signatures
Even if the use of electronic signatures is not yet regulated nationwide in professional law, the first states are already requiring electronic signatures from publicly appointed surveyors. This means that publicly appointed surveyors (ÖbVI) are required to submit documents electronically and sign them in a way that is legally binding.
In Lower Saxony, for example, the use of a qualified electronic signature on official site plans has been mandatory since last year in accordance with the building regulations.
Some countries currently allow the use of qualified electronic signatures on a voluntary basis. Other countries are planning to change their country-specific legislation.
Further fields of application are emerging
Even outside of direct professional law, other fields of application are regularly emerging in which the qualified electronic signature plays a key role. For example, it meets the high requirements for experts to communicate securely with courts or to guarantee the authenticity of the origin and integrity of the content of electronic invoices.
According to § 371a ZPO, the qualified signature preserves the evidential value of digital documents and, according to § 126a BGB, meets the requirements for written formIn addition to proving legal validity, the signature also ensures document integrity and makes it possible to prove any manipulation. This makes the digital document the original.
